If you are currently considering declaring yourself bankrupt, you need to be aware that the court fees associated with the process are now rising from 4th April 2011. In the ongoing process of making the Court Service self funding, fees will need to rise to help balance the books.
In April last year, the costs of declaring yourself bankrupt rose as well as the Official Receivers deposit, which was the fee that had to be paid to the Court to fund the OR’s investigation, was raised from £510 to £600.
The rise in fees is another blow for those who are already struggling to find the fees necessary to go through the bankruptcy process. We get many calls here to Help With Debt asking what it costs to go bankrupt and many people can’t believe what they need to try to find to deal with their debts.
Of course there is help at hand for those for instance who are on income based job seekers allowance, or for those who qualify by virtue of receipt of other benefits, or though lack of income generally. For those who qualify, there is a form called the EX160, which can be filled in and the evidence necessary to support the application gathered and presented to the court to gain a full remission. It needs some planning as without all the proper evidence the court will require full fees to be paid. If evidence can be provided up to six months later the fee can be recovered. The fee remission is available, it only remits the court fee which will be the sum of £175 from April 4th. The Official receiver’s deposit of £450 will still need to paid in all cases.
There are a few schemes which are also available to help fund even thr official receiver’s deposit. There is a charitable trust which exists to help pay the fees of those with utility debt. Also some councils it seems are willing to provide the official receiver’s deposit and recover the money advanced out of future benefit allowances.
